Terms of Service - Hailstorm

1. Acceptance of Terms

By accessing or using Hailstorm (the "Software"), you agree to be bound by these Terms of Service and the License Agreement. If you do not agree to all the terms, do not download, install, or use the Software. These terms constitute a legal agreement between you and Hailstorm regarding your use of the Software.

2. License Terms

User License ($9.99 introductory / $24.99 regular)

Grants a lifetime, non-exclusive, non-transferable license for individual use. Includes all future updates and security patches. For individual developers and personal use only.

Patron License ($100)

Includes all User License benefits plus one (1) vote in feature prioritization surveys. Supports ongoing development while providing influence over the product roadmap.

Developer License ($1,000 introductory / $2,500 regular)

Provides complete source code access for modification and internal use within your organization. Grants perpetual, non-exclusive rights to use, modify, and integrate the Software into internal tools and workflows.

Prohibited: Resale, redistribution, sublicensing, or offering the Software as-a-service to third parties is strictly prohibited. This restriction applies to both modified and unmodified versions.

3. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. HAILSTORM API CLIENT MAKE NO WARRANTIES THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAILSTORM API CLIENT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; BUSINESS INTERRUPTION; OR PERSONAL INJURY) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. IN NO EVENT SHALL HAILSTORM API CLIENT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID FOR THE SOFTWARE, IF ANY.

5. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where Hailstorm operates, without regard to its conflict of law principles. Any dispute arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
